Public Procurement Law
Public procurement law in Quebec is a highly specialized field governed by a complex and constantly evolving legislative and regulatory framework. This framework includes the Act respecting contracting by public bodies, the Act respecting contracting by municipal bodies, their implementing regulations, contractual management directives and policies, and applicable trade agreements. These rules govern every stage of the contracting process, from the preparation and publication of a call for tenders to the award, performance, modification and termination of the contract.
Julius Legal assists businesses and suppliers in analyzing tender documents, eligibility criteria and compliance requirements. The firm also advises them on their rights and remedies, including complaints submitted to a public body or the Autorité des marchés publics, challenges to rejection or ineligibility decisions, applications for injunctive relief, judicial review proceedings and claims for damages. Its work also encompasses issues involving subcontracting and the performance and modification of public contracts.
A significant part of Julius Legal’s practice concerns the integrity of businesses contracting with public bodies. The firm advises and represents clients in connection with applications for authorization and annual updates submitted to the Autorité des marchés publics, integrity reviews, requests for information and proceedings that may lead to corrective measures or sanctions. Its work includes matters involving directors, shareholders, related persons or businesses, legal or de facto control, business relationships, subcontractor eligibility and registration in the Register of enterprises ineligible for public contracts. The firm also assists businesses in developing and presenting governance, compliance and remediation measures.
In the municipal sector, Julius Legal advises businesses on the application of the Act respecting contracting by municipal bodies and contractual management regulations. The firm also represents businesses in matters involving the Bureau de l’inspecteur général de la Ville de Montréal.
